SUMMARY OF TERMS AND CONDITIONS

PURPOSE

The HOST leases the PRIMARY GUEST and their companions the property selected in their reservation, for the number of nights registered on the accommodation registration card (TRA), for exclusive use as temporary accommodation for tourism purposes.

STAY DURATION

The contract will have a duration according to the TRA and/or SIRE days record, in accordance with Decree 1074 of 2015, Law 2068 of 2020, and the external circular of the Superintendency of Industry and Commerce (SIC). After this period, the contract will be automatically terminated without prior notice.

GUARANTEE

The Primary Guest may request a guarantee for non-compliance with the quality of service within three (3) calendar days following the end of the service. If non-compliance is determined, the Host will offer, at their option, a refund or a new service under the same conditions. In the event of a repeat offense, the Guest may choose between a refund or a new service.

RIGHT OF WITHDRAWAL AND PAYMENT REVERSAL

Right of withdrawal: The PRIMARY GUEST has five (5) business days from the date of booking to exercise this right.

Payment reversal: This applies in cases of fraud, unsolicited transactions, or defective products not received. A complaint must be filed within five (5) business days of receiving notice of the fraudulent transaction.

DATA PROTECTION

The Host will process the Guest's personal data for the purpose of managing the contract. Data will not be disclosed to third parties unless required by law. The Guest may exercise their rights of access, rectification, erasure, and data portability by contacting the Host at the address provided or by email at bizsar.reservas@gmail.com.

Response times:

Queries: Maximum ten (10) business days, extendable by five (5) additional days.

Complaints: Maximum fifteen (15) business days, extendable by eight (8) additional days.

PREVENTION OF SEXUAL AND ECONOMIC EXPLOITATION OF MINORS

The HOST adheres to the CODE OF CONDUCT LAW 1336 OF 2009 to counteract the sexual exploitation of children and adolescents during tourist trips. In accordance with Law 679 of 2001, the commercial sexual exploitation of minors in Colombia is punishable by imprisonment as established in articles 188C, 208, 209, 218, and 219 of the Colombian Penal Code.

The HOST will report to the authorities any behavior that may lead to or be suspected of being a crime of Commercial Sexual Exploitation of Children and Adolescents (CSEC).

CANCELLATION POLICIES

Strict cancellation policies apply: full refund with more than 30 days' notice prior to check-in, and 50% refund with 7 to 29 days' notice prior to check-in.

FORTUITOUS EVENT AND FORCE MAJEURE

If the Guest cannot attend due to an unforeseen event or force majeure, they must notify the Guest in advance and provide official proof. In these cases, the Guest may change the reservation date based on availability or cancel with a penalty of 50% of the reservation value.

NO-SHOWS

In the case of a "No-Show," the HOST will charge 20% of the total price of the service in accordance with Article 65 of Law 300 of 1996.

HOST NON-PERFORMANCE

If the Host fails to provide the service due to negligence, they must fully refund all amounts paid for the accommodation service.
